Terms of Use (TOU)

1. Preamble

The purpose of these General Terms and Conditions of Use (hereinafter the “Terms”) is to define the terms and conditions under which any user (hereinafter the “User”) accesses the website available at https://envoi-reco.com (hereinafter the “Site”) and uses its features.

The Site is published and operated by Maxaco Limited, a company incorporated under Irish law, Office 33, 40 Patrick Street, Waterford X91 X3FK, Ireland, registration number 801621, VAT number IE4520412MH (hereinafter the “Publisher”).

envoi-reco.com is a private, independent service, separate from the services offered by La Poste. It is neither affiliated with, endorsed by, nor sponsored by La Poste, and the rates and services described on the Site are the sole responsibility of the Publisher.

These Terms of Use supplement the General Terms and Conditions of Sale (GTCS), which specifically govern orders, payment, and the provision of mail delivery services, as well as the Privacy Policy and Cookie Policy, which are also accessible from the footer of the Website. In the event of a conflict regarding a matter strictly pertaining to an order or sale, the GTS shall prevail.

Any use of the Site constitutes full and unconditional acceptance of these Terms of Use. Users who do not accept them must refrain from accessing the Site and using its services.

2. Definitions

  • User: any individual or legal entity that accesses the Site, browses it, creates an account on it, or places an order on it.
  • Website: the platform accessible at https://envoi-reco.com, including all of its pages, features, and subdomains.
  • Publisher/Service Provider: Maxaco Limited, the company that publishes and operates the Site, as identified in Article 1.
  • Customer Area: the personal interface accessible after creating an account, which allows Users to manage their shipments, history, invoices, and personal information.
  • Services: all of the features offered on the Site, including assisted letter writing (including via artificial intelligence), the use of templates, file import, ordering mailings (standard, tracked, eco-friendly, or certified mail), and tracking shipments.
  • User Content: any text, file, document, image, or information transmitted, uploaded, or posted by the User in connection with the use of the Site.

3. Access to the Site

The Site is accessible free of charge—subject to Internet connection fees—to any User with a connected device. Viewing the Site’s general pages (about us, pricing, blog, contact forms) does not require creating an account.

To access certain features—including creating, ordering, and tracking shipments, as well as accessing the Customer Portal—you must first create a user account.

The Site is intended exclusively for Users located in France, for mail shipments to mainland France. Shipments from or to other countries are not currently available.

The Publisher takes reasonable measures to ensure continuous access to the Site, but does not guarantee uninterrupted availability. Access may be temporarily suspended or restricted, particularly for maintenance, technical updates, or in cases of force majeure, without this entitling the User to any compensation.

4. Creating and Managing a User Account

Creating an account requires providing accurate, complete, and up-to-date information, including a valid email address. The User agrees to update this information in the event of any changes.

The User is solely responsible for keeping their login credentials (email address and password) confidential and for any actions taken through their account. The User agrees to promptly notify the Publisher at relation-client@envoi-reco.com in the event of loss, theft, or unauthorized use of their account.

The Publisher reserves the right to suspend or terminate, after providing prior notice where possible, any account whose use violates these Terms of Use, the Terms and Conditions of Sale, or applicable regulations, particularly in the event of proven or suspected fraud, the provision of manifestly false information, or the use of the Site for unlawful purposes.

The User may request the closure of their account at any time by contacting support at relation-client@envoi-reco.com, without prejudice to any obligations arising prior to the closure (including payment for pending orders).

5. Description of the Website's Features

The Site offers the following features, among others; commercial details and pricing are set forth in the Terms and Conditions and on the Site’s Pricing page:

  • The User's ability to freely compose a letter;
  • The use of pre-written letter templates made available on the Site;
  • Writing assisted by an artificial intelligence tool that generates a draft letter based on information provided by the user;
  • Importing a personal document (file) to print and send it;
  • Ordering a mailing via “Lettre Verte,” “Lettre Suivie,” or “Lettre Recommandée,” including printing, envelope stuffing, and drop-off at the post office;
  • Online tracking of mail delivery and access to shipment history and invoices through the Customer Portal.

These features are provided as tools to facilitate the preparation and sending of correspondence. The Publisher does not guarantee that content generated by the artificial intelligence tool or derived from the provided templates is suitable for any specific legal or administrative situation: it is the User’s responsibility to verify and, if necessary, adapt the content before confirming their order.

6. User Obligations and Commitments

By using the Site, the User agrees to:

  • Provide accurate information regarding your identity, the sender, and the recipient of the mail;
  • Use the Site only in compliance with applicable laws and regulations;
  • Do not transmit, post, or have printed, via the Site, any User Content that is unlawful, defamatory, abusive, fraudulent, infringing on the rights of a third party (including intellectual property rights or the right to privacy), or contrary to public policy;
  • Do not use the Site to impersonate, harass, or intimidate a third party;
  • Do not attempt to disrupt, overload, or circumvent the normal operation of the Site, its security measures, or its payment systems;
  • Do not automatically and systematically extract, copy, or reuse the content or data from the Site (a technique known as “scraping”);
  • Do not use the Site's features—including the AI-powered writing assistant—to generate or have printed content that is unlawful or intended to harm a third party.

The User remains solely responsible for the content of the messages he or she sends via the Site, for the legality of that content, and for his or her use of the Services. The Publisher does not exercise any systematic editorial control over User Content prior to its submission, but reserves the right to refuse or suspend any submission that it knows to be manifestly unlawful.

7. Intellectual Property

All elements comprising the Site—text, layouts, illustrations, logos, icons, videos, databases, letter templates, algorithms, and software features, including those related to the AI-assisted writing tool—is protected by intellectual property law and remains the exclusive property of the Publisher or its rights-holding partners.

No provision of these Terms of Use shall be construed as granting the User a license or right to use these elements, except for the strictly personal right to use the Services as necessary to send their own email.

Any reproduction, representation, extraction, adaptation, or reuse—in whole or in part—of the elements of the Site, for purposes other than the User’s personal use in connection with the Services, is strictly prohibited without the Publisher’s prior written authorization and may constitute an act of infringement.

User Content (written text, imported files) remains the property of the User or the third party holding the relevant rights. The User warrants to the Publisher that he or she holds all rights and authorizations necessary for the transmission, printing, and sending of this content.

8. Personal Information and Cookies

The Site collects and processes personal data in connection with account creation, order management, shipment tracking, and customer relations, in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679).

The methods of data collection, the purposes of data processing, retention periods, and the User's rights (access, correction, erasure, objection, restriction, and portability) are detailed in the Privacy Policy, which can be found at the bottom of the Website.

The Site uses the Cookiebot solution to manage consent for cookies and trackers, as well as Google Analytics for audience measurement purposes. Users may manage their preferences at any time via the cookie management panel accessible at the bottom of the page, or withdraw their consent.

9. Availability and Changes to the Site

The Publisher reserves the right to modify, update, suspend, or discontinue, at any time and without notice, all or part of the Site’s features, particularly for technical or security reasons or to update its offerings, without incurring any liability in this regard, subject to orders currently being processed.

The Publisher does not guarantee that the Site will be free of errors, interruptions, or bugs, nor that it will function without interruption on any type of device, browser, or Internet connection.

10. Liability

The Publisher agrees to take reasonable measures to ensure the proper functioning, security, and accessibility of the Site. The Publisher is bound only by an obligation of means.

The Publisher shall not be held liable for:

  • Damages resulting from use of the Site that does not comply with these Terms of Use;
  • Consequences resulting from incorrect, incomplete, or inaccurate information provided by the User (address, email content, recipient’s contact information);
  • Interruptions, malfunctions, or unavailability of the Site due to external causes (network outage, failure of a technical service provider, cyberattack, force majeure);
  • The content of third-party websites accessible via links on the Site.

The terms and conditions governing liability for the fulfillment of mail-order requests (time frames, delivery, refunds) are set forth in the General Terms and Conditions, which take precedence on this specific point.

11. Links to Other Contractual Documents

These Terms of Use should be read in conjunction with the following documents, which are accessible from the footer of the Site:

  • The General Terms and Conditions of Sale (GTC), applicable to all orders for Services;
  • The Privacy Policy, regarding the processing of personal data;
  • Cookie Policy;
  • Subscription Terms and Conditions, applicable to the monthly subscription.

12. Changes to the Terms of Use

The Publisher reserves the right to modify these Terms of Use at any time, in particular to adapt them to changes to the Site, its features, or applicable regulations. The current version is the one published on the Site on the date of access.

In the event of a substantial change, the Publisher will endeavor to notify Users with accounts by any appropriate means (notification on the Site or via email). Continued use of the Site after the new Terms of Use take effect constitutes acceptance of them.

13. Governing Law and Jurisdiction

These Terms of Use are governed by Irish law, to the exclusion of any other laws.

In the event of a dispute regarding the interpretation or performance of these terms that cannot be resolved amicably, the Parties agree to the jurisdiction of the Irish courts, without prejudice to any mandatory provisions that may apply to the consumer under the law of his or her country of residence.
